Universal Music Group’s UMG Recordings and Capitol Records, together with Sony Music Entertainment, are seeking DistroKid distribution records through a non-party subpoena connected to their Massachusetts litigation against Suno. A proposed order filed October 15 in the Southern District of New York, case 1:26-mc-00510, requests monthly totals for recordings delivered, tested and scored as likely AI-generated, as well as streams and royalties for flagged recordings. It also seeks counts attributed to Suno where the prediction model can identify that source. DistroKid is identified as a third party in this subpoena proceeding.
The requested disclosure extends beyond upload totals to the prediction model’s vendor, start date, ability to identify particular AI services and information about accuracy and false positives. Those details would help establish what the resulting figures can reliably show: a model’s probability score is not a finding of copyright infringement. The proposed text requests production by October 30, but its grant language is unsigned draft wording, not proof that a judge has ordered compliance. The filing establishes the scope of the requested evidence; it does not establish how many DistroKid uploads are AI-generated or resolve the underlying copyright claims.
