Reservoir Sues Suno and Anthropic Over AI Training and Allegedly Infringing Outputs

Reservoir’s separate lawsuits challenge Suno’s alleged use of recorded compositions and Anthropic’s alleged use of lyrics in training and generated outputs.

Independent music publisher Reservoir has filed separate lawsuits against Suno and Anthropic, alleging unauthorized use of its songs in both AI development and generated outputs. Filed October 21 in California federal court, the Suno complaint identifies 1,050 compositions, while the Anthropic complaint covers 853. Reservoir alleges that Suno copied audio recordings containing its protected compositions to train its music-generation models, which subsequently produced music containing protected expression. Its Anthropic case concerns lyrics allegedly collected from websites and other text sources, retained in a central library and copied for successive Claude training runs. Reservoir also alleges that Claude supplies protected lyrics or creates unauthorized adaptations in response to prompts. These claims extend beyond a single initial training event, but do not establish that either system retrieves an original song every time it generates a response.

The lawsuits concern publishing rights in underlying compositions, distinct from ownership of particular master recordings. Reservoir’s catalog includes songs recorded by Joni Mitchell, Madonna, Johnny Cash and Evanescence. Both complaints bring copyright infringement claims alongside allegations that the companies bypassed technical restrictions and removed identifying copyright information. Their combined statutory-damages calculations total approximately $337.8 million, contingent on establishing the alleged violations and applicable damages requirements—not an amount awarded by a court. Reservoir also seeks injunctions and removal or destruction of unauthorized copies. Anthropic told Billboard that it disagrees with the allegations and intends to defend the case; Suno declined comment, according to the reporting. The two proceedings remain separate, and Reservoir’s allegations have not been established as findings of liability.

The Three Alleged Forms of Wrongdoing

AllegationWhat Reservoir claims
Copyright infringementProtected compositions or lyrics were copied without authorization for AI development, with further infringement allegedly occurring through generated outputs.
Circumvention of technological access controlsTechnical restrictions were allegedly bypassed to obtain protected material. The Suno complaint specifically identifies tools allegedly used to bypass YouTube’s protections and download audio.
Removal or alteration of copyright-management informationInformation identifying songs, songwriters, publishers or copyright owners was allegedly stripped during collection or processing. This is more specific than simply omitting a credit from an AI-generated result.

These are allegations requiring proof. Training a model, retaining source material and generating an infringing output involve distinct factual and legal questions.
